These terms apply to your use of wollondillytreeservices.com.au (the website), operated as Wollondilly Tree Services. By using the website or submitting an enquiry through it, you accept these terms. If you do not accept them, please do not use the site.

1. What this website does

This website is a referral service. It collects enquiries about tree and vegetation work in the Wollondilly Shire and passes them to independent tree contractors operating in the area.

The website operator does not perform tree work. It does not climb trees, operate machinery, quote jobs on site or issue invoices for tree work. Our Disclaimer explains this in full and should be read together with these terms.

2. No contract for tree work is formed here

Submitting an enquiry does not create a contract for tree work, and it does not oblige anyone to attend, quote or accept your job.

Any contract for tree work is formed directly between you and the contractor you are introduced to. Price, scope, timing, payment terms, warranty and everything else are agreed between you and them. The website operator is not a party to that contract and is not your agent or theirs in negotiating it.

3. Quotes and pricing

Nothing on this website is a quote, an estimate or an offer to perform work at any price. Any figure, range or example mentioned on the site is general illustration only. Tree work pricing depends on access, size, species, ground conditions, disposal and risk, none of which can be assessed from a web page.

A binding price only exists when a contractor has inspected the job and given it to you in writing. Get it in writing.

4. Information on this site is general

Pages on this site describe local conditions, tree species, and the rules that Wollondilly Shire Council, the NSW Rural Fire Service and NSW legislation apply to tree and vegetation work. It is written in good faith and researched from published sources, but it is:

  • general information, not advice about your tree, your block or your situation;
  • not an approval, permit, exemption or certification of any kind; and
  • subject to change — council policies, exemption lists, fees, application processes, hazard reduction rules and mapped clearing entitlement areas all change over time.

You are responsible for confirming your own position with Wollondilly Shire Council and, where bushfire clearing is involved, with the NSW Rural Fire Service, before any work starts. Where this website and those authorities disagree, they are right and we are not.

5. Your responsibilities

When you use this website you agree that:

  • the information you give about yourself, the property and the job is accurate;
  • you either own the property or have the owner's authority to arrange work on it;
  • you will obtain any council approval, permit or consent required for the work;
  • you will satisfy yourself about a contractor's qualifications, licences and insurance before letting them start; and
  • you will not use the website unlawfully, attempt to interfere with it, scrape it, or submit false or malicious enquiries.

6. Contractors are independent

Contractors introduced through this website are independent businesses. They are not employees, agents, partners or franchisees of the website operator, and we do not supervise, direct or control their work.

We do not verify, endorse or guarantee any contractor's licences, qualifications, insurance cover, workmanship, safety practices, pricing or availability. Ask to see a current public liability insurance certificate before work begins, and ask about qualifications relevant to the job.

7. Referral arrangements

The operator of this website may receive a fee or other commercial benefit in connection with enquiries referred to contractors. This does not increase the price you are quoted and does not oblige you to use anyone you are introduced to. You are free to obtain other quotes and you should.

8. Intellectual property

The text, layout, design and images on this website are owned by the operator or used under licence. You may read, print and share pages for your own personal or business use. You may not republish, copy or adapt substantial parts of the site for commercial purposes without written permission.

Where we link to a council page, a government agency, an information service or any other external website, that is for your convenience. We do not control those sites, do not endorse their content, and are not responsible for it.

10. Availability

We aim to keep the website available and accurate but do not guarantee uninterrupted access, freedom from errors, or that content is current at every moment. The site may be taken down, changed or discontinued at any time without notice.

11. Limitation of liability

To the maximum extent permitted by law, the operator of this website is not liable for any loss, damage, injury, cost or expense arising from or in connection with:

  • the website being unavailable, delayed or containing an error.

12. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where liability can be limited rather than excluded, it is limited to resupplying the relevant service or paying the cost of having it resupplied.

13. Governing law

These terms are governed by the laws of New South Wales, Australia, and you and we submit to the courts of that state.

14. Changes to these terms

We may update these terms. The version published on this page is the one that applies, with the last-updated date shown above. Continuing to use the site after a change means you accept the updated terms.
